These terms are an agreement between you and Stampwell. By creating an account or getting a card, you accept them. If you don't accept them, please don't use Stampwell.
1. The service
Stampwell lets businesses ("shops") create digital loyalty cards (stamp cards, coupons, discounts and memberships). Their customers keep the cards in Apple Wallet, Google Wallet or on a web page. Shops run everything from the Stampwell app for iPhone and Android. Stampwell is offered in the Philippines.
2. Accounts
To open a shop account you must be at least 18 and able to enter into a contract, and you must use it for a real business.
You're responsible for your account and for the staff you invite. Remove staff who leave.
Keep your sign-in secure, and tell us if you think someone else is using your account.
3. Plans and billing
There's a Free plan and paid plans. Current prices and limits are on stampwell.app and in the app. Prices include VAT.
Paid plans are subscriptions bought in the app. Apple or Google charges you, and their terms cover payment, renewal and refunds. A subscription renews until you cancel it in your App Store or Google Play settings.
If we change a price, the new price applies from a renewal after we tell you. Apple or Google may ask you to accept it.
If a payment fails, your shop keeps full service for 7 days and then moves to the Free plan. You choose which card and location stay fully active. Your customers keep their cards.
Refunds are handled by Apple or Google under their policies.
4. Your customers' data
Your shop is the personal information controller for the customer data it collects through Stampwell. Stampwell processes that data for you, under the Data Privacy Act of 2012 (Republic Act No. 10173).
You agree to:
ask customers only for details your loyalty program needs;
send promos only to customers who agreed to receive them, and stop when they ask;
act on customers' requests to see, correct or delete their data (the "Delete my data" link on every card handles most of these);
keep customer exports secure and delete them when you're done;
follow the Data Privacy Act and the National Privacy Commission's rules that apply to you.
We agree to use your customers' data only to run Stampwell for you, keep it confidential, protect it as our privacy notice describes, use only the service providers listed there, help you answer customer requests, and tell you without delay about a breach that affects your customers. When your account is deleted, we delete your customers' data.
5. Rewards
You decide your rewards, and you're responsible for honouring them. Stampwell isn't part of the promise between you and your customers. If you end a card, customers keep any unclaimed rewards for the period you set.
6. Acceptable use
Don't use Stampwell to:
break the law, or mislead or defraud anyone;
reward customers for reviews, ratings or social media posts;
upload content you don't have the right to use, or that is offensive;
break, overload, copy or reverse engineer the service, or get around plan limits;
reach data that belongs to another shop.
7. Your content
You keep ownership of the logos, designs and text you upload. You allow us to use them to run the service, for example to draw your cards, posters and shop page. If you make your shop public, its name, address and cards appear on stampwell.app and on the "Shops near you" map.
8. Ending your account
You can stop using Stampwell at any time and delete your account in the app. Cancel your subscription separately in the App Store or Google Play. We may suspend or close an account that breaks these terms or puts others at risk, and we'll tell you why unless the law stops us. If we ever close Stampwell, we'll give shops reasonable notice first.
9. Disclaimers
Stampwell is provided "as is" and "as available". We work to keep it running and accurate, but we can't promise it will never be interrupted or free of errors. Wallet cards also depend on Apple and Google. Nothing in these terms takes away rights you have under Philippine law that can't be waived.
10. Limits on liability
As far as the law allows, Stampwell isn't liable for indirect or consequential losses, lost profits, or rewards a shop fails to honour. Our total liability to you is limited to what you paid for Stampwell in the 12 months before the claim. These limits don't apply to fraud, gross negligence, or anything else the law doesn't allow us to limit.
11. Governing law
These terms are governed by the laws of the Philippines. Disputes go to the proper courts of the Philippines.
12. Changes
We may update these terms. We'll change the effective date above and tell shop owners before a significant change takes effect. If you keep using Stampwell after that, the new terms apply.
